Should I Request a Fair Hearing? How to Use a Medicaid Request for Fair Hearing to Your Advantage

As of March 31, 2023, the continuous Medicaid enrollment requirement due to the COVID-19 pandemic has ended. With the return to “normal” policies, we should not be surprised if clients need to appeal incorrect decisions about their benefits and/or continued eligibility. You know what that means – it is time to request a Fair Hearing.

Whether a client is being denied continued Medicaid enrollment or this is a first time applicant and the agency is incorrectly processing the Medicaid application (i.e., misinterpreting a simple Medicaid Eligibility Handbook provision, such as calculating the community spouse asset share or utilizing the Name on the Check Rule) you may want to request a Fair Hearing to expedite a resolution and enrollment for your client.

Filing for Fair Hearing can sound intimidating, but there is no reason to be afraid if you understand the process. This presentation will review the entire process of filing to attending Fair Hearing from start to finish, including how to file a Motion for Award of Attorney’s Fees and Costs.
