A lawyer’s dual responsibilities as advocate and officer of the court often come into conflict. One common area of conflict is the process of preparing witnesses and presenting their testimony. While competent and diligent representation requires helping a witness effectively tell their story, a lawyer may not encourage the witness to present false or misleading testimony. This program explores the applicable Wisconsin disciplinary rules and the guidance they provide to lawyers involved in preparing witnesses and presenting their testimony.
