Since annual and lifetime limits in group medical plans were eliminated under the Affordable Care Act, there has been substantial growth in the number of extraordinary claims being experienced by employer group health plans, many from specialty drugs that did not exist when the ACA was enacted. Many medium-sized and even small employers have switched to self-funding but are now learning that a large “lasered” health claim can wreak financial havoc on the employer. Even fully insured health plans encounter significant annual premium increases due to large claims. Attorney Charlie Stevens of the Milwaukee office of Michael Best & Friedrich will describe the difficulties employer health plans are now encountering, the statutes, regulations and “subregulatory guidance” employers and plan administrators must take into account, and practical considerations for employers and their health plans associated with high claims.
