Booking.com: How the Supreme Court's Decision Affects Trademark Descriptiveness Analysis and Practical Implications for Trademark Practitioners Presenter: Heidi Thole, Reinhart Boerner Van Deuren s.c. In United States Patent and Trademark Office et. al. v. Booking.com B.V., the Supreme Court recently held that a term stylized "generic.com" is only a generic name for a class of goods or services if the term has that meaning to consumers. The Majority Opinion rejected the U.S. Patent and Trademark Office's nearly per se rule that a generic term, when combined with a generic domain suffix like ".com", would be generic. While this case was a win for Booking.com B.V., this CLE will explore the court's decision, the arguments and evidence that persuaded the court to find in Booking.com B.V.'s favor, and how trademark practitioners can apply these lessons to help clients obtain trademark registration for domain names and overcome other generic refusals during trademark prosecution.
