This program will examine the status of pandemic-induced local and national eviction moratoriums and the resulting impact on bankruptcy case filing volume. The presenters will review the manner in which real estate leases are treated in bankruptcy, wh ich will include a look at recent case law interpreting “force majeure” cla uses. Finally, we will identify best practices for landlords and tenants wh en the tenant seeks to reorganize under Chapter 11 or Chapter 13.
