Cybersecurity and Privacy Claims Against Businesses

Presenter:  Zach Willenbrink, Godfrey & Kahn, S.C.

This program will discuss three of the most common types of cybersecurity and privacy disputes: individual claims following data breaches, disputes that arise after a funds-transfer fraud (a/k/a wire fraud), and web-tracking claims premised on California wiretapping laws (which are rapidly expanding to states across the US, including Wisconsin). Attendees will learn how decisions made when responding to an incident, such as notifying individuals and regulators of a breach or acting quickly to freeze transferred funds incident response decisions, can shape a business’s exposure and risk. We’ll also discuss emerging theories and claims being pursued by plaintiffs and common defense strategies used when litigation arises.
