A Practical Guide to Phase I Environmental Site Assessments (ESAs): What Phase I ESAs Are and Are Not, What Environmental Due Diligence Issues to be Aware of, and the Requirements of the New ASTM Standard for Conducting Phase I ESAs (E1527-21)

Real estate and environmental attorneys are often involved in retaining environmental consultants and commissioning Phase I Environmental Site Assessments (ESAs) on behalf of their clients as part of the environmental due diligence process that is associated with the purchase of real property. Unless counsel has a good understanding of what is included (and what is not included) in Phase I ESA due diligence, important issues may be missed (e.g., the presence of wetlands or endangered species) that can completely halt or delay a potential real estate transaction. This seminar will discuss what Phase I ESAs are and what they are not, will discuss the type of environmental considerations (known as “Phase I “Non-Scope Considerations”) that should be considered whenever environmental due diligence is being contemplated and will also cover the requirements that have been created by the American Society of Testing & Materials (ASTM) in their recently adopted industry Standard Practice for conducting Phase I ESAs (i.e., ASTM Standard Practice E1527-21). This is a practical-based seminar that will include important practice pointers for counsel involved in environmental due diligence.
