Life After Bostock: A year (and a half) in review

In 2020, the Supreme Court held that Title VII applies to protect gay and transgender workers from employment discrimination. In doing so, the Supreme Court also established that the but for causation standard is intended to be a broad one – but-for cause, after Bostock, does not require proof of sole causation. Attorney Summer Murshid discusses how courts have been applying that standard in the year and a half since Bostock and whether the change to the causation standard could potentially impact discrimination litigation generally.
